To me this is a perfect example of how idiotic the whole legal process has become from way too many individuals wanting to exercise obscure points in order to gain their 15 minutes of fame.
Artistic License has always been an important tool to the process of creativity. Students are taught to use photographs as subject matter for art assignments in school, why is this allowed and yet as soon as someone does start having success they are told it is wrong???
In my mind when a photographer takes a picture and publishes it, he or she at that time relinquishes all rights to the photo unless it is published as an original work of art.
The Obama photo was an AP photo which means it was shown all over the world. If this is the case, singling out one artist to pursue for monetary compensation is discriminatory and just plain greedy on the part of the photographer.

Copyright is a very grey area but I cannot believe that something like this is considered an infringement. However, money talks in these cases.

Fairey's rendering brings the blue-red contrasts and emotions of potential cooperation to the foreground. The original photograph, although excellent, does not bring forth these emotions.
